Terms and Conditions of Online Sale
These Terms and Conditions of Sale (hereinafter “Conditions”) govern the distance sale via the web of Prodigee products (hereinafter Products) available on the website www.prodigee.eu (hereinafter Site), in accordance with the provisions of the Consumer Code Legislative Decree 206/2005, Legislative Decree 70/2003, and Directive 2000/31/EC as amended on 17/2/2024.
The Seller reserves the right to update and modify these Conditions. The new conditions will take effect from the moment of their publication on the Site for orders placed thereafter. It is the Customer’s responsibility to check the conditions in effect at the time of purchase.

2. Object
2.1. These Conditions govern the distance sale via the web of Prodigee products (hereinafter “Products”) presented and offered for sale on the website www.prodigee.eu (hereinafter Site) to final consumers (hereinafter “Customer” or “Customers”).
3. Contract Conclusion Methods
3.1. The Customer submits an Order Proposal by adding the Product to the shopping cart.
3.2. To complete the order, it is necessary to proceed to the checkout phase. The Customer views the order summary showing the total price of the products in the cart including taxes and shipping charges.
3.3. The Customer can transmit the order proposal in the following ways:
a) Creating a personal account on the website. During registration, the Customer must provide personal data and shipping and billing address. The Customer can choose shipping and payment options and correct input errors before submitting the order and add notes. After confirming data accuracy, the Customer transmits the Proposal to the Seller and proceeds with payment.
b) Proceeding to the traditional guest checkout by clicking “Proceed to checkout.” The Customer fills in required details for contract conclusion: contact info, shipping address, shipping options, payment method, and can correct errors or add notes. After verification, the Proposal is sent to the Seller and payment proceeded.
c) Proceeding with express checkout choosing a payment method among Paypal, Pay in Installments, and Google Play. The Customer is redirected to the third-party payment provider’s servers. The shipping and billing addresses from the linked account are used; the Customer must verify correctness. The Seller is not responsible for failed or delayed deliveries due to incorrect data in third-party payment platforms.
3.4. Submitting the Order Proposal implies acceptance by the Customer of these Terms of Sale.
3.5. After receiving the Proposal, the Seller sends a summary confirmation of the order to the Customer via the email address provided during checkout, confirming receipt and acceptance.
This confirmation constitutes the contract conclusion date.
3.6. The Seller reserves the right not to accept an order if:
a) The product is not available;
b) The Customer cannot be qualified as a consumer;
c) The payment fails;
d) The Customer’s data is incorrect.
3.7. In case of non-acceptance or partial acceptance, the Seller communicates by email and refunds any amounts already paid.
4. Sale Price
4.1. All product prices on the Site are in Euro and include VAT and any other taxes.
4.2. Shipping costs are not included in the product price and are indicated at checkout before order submission.
4.3. The Seller may change prices at any time; however, the price applied to an individual order is the one shown at the time of submitting the Order Proposal.
4.4. Any price reduction announcement indicates the previous price before reduction.
5. Payment Methods
5.1. The Customer may pay by:
a) Paypal
b) Apple Pay
c) Google Pay
d) Credit/rechargeable cards – Visa, Mastercard, Maestro
5.2. Payments are handled by third-party providers. The Seller does not have access to bank or card data and cannot store them. The Seller is not responsible for transactions managed by third parties.
6. Shipping and Delivery
6.1. Shipments are made by courier selected by the Seller.
6.2. Shipping is available to Andorra, Austria, Belgium, Croatia, Estonia, Finland, France, Germany, Greece, Ireland, Italy, Latvia, Lithuania, Luxembourg, Monaco, Netherlands, Portugal, San Marino, Slovakia, Slovenia, Spain, Vatican City.
6.3. Delivery occurs within 3-5 working days of shipment and no later than 30 days from order acceptance.
6.4. The Seller is not responsible for delivery delays due to force majeure or unforeseen events.
6.5. The Seller is not responsible for delivery delays due to the carrier.
6.6. Delivery is made to the address provided in the order. The Seller is not liable for failed delivery due to incorrect or non-existent addresses.
6.7. Risk of loss or damage passes to the Customer upon physical delivery of the product; if the carrier is chosen by the Customer, risk passes when Seller gives the product to the carrier.
6.8. The Customer must check the packaging integrity and visible damage upon delivery and immediately report to the carrier or Seller. The Customer may refuse delivery if the packaging is damaged.
7. Right of Withdrawal
7.1. The Customer has the right to withdraw from the Contract within 14 days of delivery for any reason.
7.2. Upon withdrawal, the Customer must return the Products to the Seller within 14 days of communicating the intention to withdraw. All accessories and original packaging and labels must be included and in good condition.
7.3. Withdrawal is exercised by filling in the withdrawal form available under “Returns and Refunds” on the Site. Late submission leads to loss of the right of withdrawal.
7.4. The Seller refunds all payments within 14 days of receiving the withdrawal form using the same payment method initially used.
7.5. Return shipping costs are borne by the Customer.
7.6. The Customer is liable for any product value depreciation caused by handling beyond what is necessary to establish nature, characteristics, and functioning. The Seller may deduct from the refund the amount corresponding to such depreciation.
8. Legal Warranty
8.1. The Seller is responsible for any defect or non-conformity of the Products with the Order.
8.2. Legal warranty lasts two years from delivery.
8.3. In case of non-conformity, the Customer may choose:
a) Restoration by repair or replacement unless impossible or disproportionately costly to the Seller with no cost to the Customer;
b) Proportional price reduction;
c) Contract termination.
8.4. Options b) and c) apply only if repair/replacement was not done, defects appear after repair/replacement, defects are serious, or restoration is not feasible in reasonable time.
8.5. Contract termination must be declared in writing to .
9. Jurisdiction and Dispute Resolution
9.1. These General Conditions are governed by Italian law.
9.2. Disputes may be subjected to extrajudicial alternative dispute resolution (ADR) as per the Ministry of Enterprises and Made in Italy website link provided.
9.3. Use of ADR does not prevent the Customer from seeking judicial protection.
9.4. Civil disputes fall under the jurisdiction of the court where the Customer resides or is domiciled.
10. Site Usage Conditions
10.1. The Site and its content are copyright protected and exclusively owned by Seller Bellelli Srl. Using the Site implies acceptance of use conditions.
10.2. The Seller grants no license or rights except to consult content. Reproduction, distribution, sale, or supply to third parties is prohibited.
10.3. Logos and trademarks on the Site are owned by the Seller; unauthorized use is prohibited.
10.4. Account creation is at Customer’s discretion. The Seller is not responsible for account activities. The Customer is liable for damage from improper use or abuse and must keep account credentials confidential.
11. Data Processing
11.1. Personal data provided by the Customer for contract execution will be processed respecting EU Regulation 679/2016 (GDPR).
